Any property with a building violation does not go to the Article 100 Commission in the following cases:
According to the directive number 8616/1/3/34 dated 1992/04/38 of the Ministry of Interior, residential buildings constructed before 1987 with the following conditions and without referring the case to the Article 100 Commission have been determined and the work should be completed. .
A- Density buildings
In this regard, a number of residential buildings located within the legal limits of the city and within the building density permitted in the plan were built before 1366/01/01 and the building violations committed in them are as follows:
1) The building is constructed without a building permit or a surplus on the permit.
3) Development of residential units in terms of floors or non-compliance with 60 percent of the permitted length and area.
3) No construction of residential unit parking
4) Construction of additional
5) Construction of narrowing on one floor and more
Without referring the case to the Article 100 Commission, the problem shall be resolved and finalized upon receipt of all relevant fees related to the extent of the violation.
b- Overdensity building violation
In this regard, the number of residential units built in the relevant use in some way has building violations in excess of the permitted density contained in the approved comprehensive, detailed and conductive plans and are related to before 1367/01/01; If the amount of violation in each residential unit is a maximum of 50 square meters, the case will be resolved without referring the case to the Article 100 Commission without referring it to the Article 100 Commission.
c- In the case of residential buildings constructed before 1367/01/01 that have been requested for renovation and become the best of them; If they have violations of urban planning and municipal regulations, in terms of total destruction of the property and conversion of the best of them without referring the case to the Article 100 Commission, only a new building permit will be issued in accordance with the relevant regulations.
