The simple explanation of the conflict of interest is that a person cannot sit on both sides of the same table at the same time, on one side of the table, be the operator and approver of the approvals, and on the other side of the table, be the beneficiary and beneficiary of the aforementioned approvals. On one side, he is the executive of the approvals and at the same time, on the other side, he supervises the implementation of the same approvals.
In other words, the person in question is placed in a position of conflict of interest.

The executive regulations of the law on the issue of selecting a supervising engineer also have a similar statement that the supervisor of a project cannot be the executor of the same project at the same time.

Ironically, for this reason and a similar reason, it does not consider the selection of the supervisor as one of the owner’s powers, and the organization must select the supervising engineer and introduce it to the owner.

The Minister of Roads and Urban Development has notified the organizations of the conflict of interest and based on this, he has prohibited some of the engineers from being on the board of directors and the organization’s organs (without resigning from their position) and even the use of employment permits for those who are in the organization’s organs. and some employees of departments and other organizations have banned.

But in the issue of holding elections for the construction engineering system organization, the ministry itself does not pay attention to the conflict of interest!

1. According to the engineering system law and its executive regulations, only the elections of the first term of the organization’s board of directors should be held by the ministry.
But until now, when the 9th term is being held, the said ministry considers this as its right and has direct and complete involvement in all election matters!

2. We have the most conflicting interests in the field of holding elections:

While the law considers the Ministry of Roads and Urban Development as the election monitoring body,

At the same time, the Ministry of Roads and Urban Development chooses the executive board!

The supervisory board, which itself has chosen the executive board, supervises the performance of the executive board!

3. We are present in Razavi Khorasan province

The General Administration of Roads and Urban Development selects the executive board. Some members of the executive board are retired employees of the General Administration.

The staff members of the election executive board are almost all respectable and honorable employees of the General Road and Urban Development Department, whose main job is as an employee of the General Road and Urban Development Department (that is, they have two heads at the same time during the operation of the election executive board, each of whom has a different responsibility in the election One is the head of the supervisory body and the other is the head of the executive board!

Have you noticed that in municipal, provincial and national elections, the executive body is usually the Ministry of Interior (government) and the supervisory body is the Guardian Council or the Islamic Council, and none of them have the authority to choose other positions for these positions and only have a supervisory position!

We hope that the responsibility of conducting elections according to the law will be handed over to the country’s engineering system and that the supervisory board will only be an observer and we will not witness arbitrary implementation of the law.
