America and Iran 2021
Return to JCPOA or Resolution 2231
From #Shahram_Yazdi
Trump is leaving the White House today and Biden will be sworn in as the President of the United States in a few minutes.
In Iran and many countries of the world, the discussion of America’s return to the JCPOA is at the top of the news and analysis, many of which analyze the JCPOA without paying attention to the provisions of UN Security Council Resolution 2231.
America’s return to the JCPOA is not practical or even logical and requires detailed and time-consuming negotiations
But the return of the United States to the implementation of UN Security Council Resolution 2231, which guarantees the implementation of the JCPOA for 200 UN countries, is sufficient for Iran and does not require any negotiation.
A point that most commentators inside and outside the country do not pay attention to is that the members of the United Nations, including the 6 members of the JCPOA and the rest of the countries, were and are required to implement Resolution 2231.
What should be done with the coming of Biden is the cancellation of all the sanctions contrary to Resolution 2231 and the sanctions of the JCPOA that America and only America ignored.
Iran also needs to align its activities with the JCPOA’s initial commitments, which is the only place where negotiations between Iran and the US are necessary, which is not impossible and does not take a particular time, considering Iran’s declarations in previous years.
Currently, the country that has failed to implement Resolution 2231 the most and has turned its back on the JCPOA is America, not Iran, and the one who should take the biggest steps is America, not Iran.
American actions can only be done by the presidential decree because there has never been a law approved by the Senate and Congress for them to interfere
Basically, according to the principles of international relations, governments are responsible for the implementation of international agreements, not their parliaments
And if in countries like Iran, the governments are under the supervision of their parliaments or are bound to get the approval of the parliaments, getting the approval of the parliaments is an internal matter and the parliaments are never committed in foreign negotiations.
All in all, now, the ball is in America’s court, and America must take the first step and return to its commitments, so that the way for any negotiations is basically opened.
Compensating for past violations can only be achieved by implementing the outstanding obligations of America, and Biden also knows that he cannot do any other negotiations with Iran unless he implements Resolution 2231 in full.
The JCPOA was not concluded in a vacuum
agreement; It is a comprehensive program of joint action in the implementation of Resolution 2231
Any sanction contrary to Resolution 2231 will cause the JCPOA to be canceled or closed
Therefore, the discussion of the continuation of bank sanctions under the pretext of the missile program or human rights problems is contrary to the implementation of the resolution and the provisions of the JCPOA and is a false assumption.
Biden is wiser than to repeat the mistakes of the idiot Trump, and the Iranian government and the Ministry of Foreign Affairs are wiser than to go under the burden of a new commitment without paying attention to the provisions of Resolution 2231.
