Supervising Engineers Affairs Council (Safe Council)
Convening the meetings of the Security Council and dealing with the cases will strengthen the system supervision and reduce the range of violations in the field of construction.
According to Note 7 of Article 100 of the Law of Municipalities, if there is a violation in construction, the case will be dealt with by the Commission of Article 100, and the violation of supervising engineers will be dealt with by the Security Council.
The members of the Security Council are:
a) Members with voting rights:
1- Director General of Architecture and Construction (Chairman of the Council)
2- Deputy General Administration Building (Vice President)
3- Director General of Executive Affairs of Article 100 Commissions (Council Member)
4- Director of Supervising Engineers (Council Member)
5- Manager of construction quality improvement (council member)
b) Members without voting rights:
1- Expert of the building deputy of the General Directorate of Architecture and Construction (Secretary of the Council)
2- Representative of the Disciplinary Council of the Construction Engineering System Organization of Tehran Province (invited)
3- Assistants of architecture and urban planning of regions (invited)
4- The representative of the security and inspection unit of the vice-chancellor of urban planning and architecture (inspector)
5- Other managers and experts of the region as determined by the chairman of the meeting as (invited)
After the meeting and review of the proposed files, three situations will happen:
1- The case is generally rejected or acquitted.
2- The case is rejected by obtaining a commitment from the supervisor.
3- The case will be sent to the Disciplinary Council of the Construction Engineering System Organization of the province for final consideration and application of the law.
If the supervising engineer announces the phased reports on time and mentions the violation in that matter, the complaint will be rejected and otherwise the mentioned case will be sent to the disciplinary council to review the performance.
The case examined in the Disciplinary Council has been decided to apply the result of that council’s decision with a sentence of one to six months according to Article 90 and 91 of the Engineering and Building Control System Law, and then the supervising engineer will be prevented from continuing his work based on the conviction.
Major violations investigated in the Security Council:
1- Excess building over density
2- Increasing or developing classes
3- Construction of a building in 100% of the property
4- Change of use
5- Reducing the dimensions of stairs and elevators
6- Reducing the dimensions of the reflector
7- Removing the light bulb
8- Lack of adequate lighting
9- Increasing the number of units
10- Failure to implement partitioning according to the approved plans
11- Violation of passage
12- Longitudinal advancement more than 60+2%
13- Parking deficit
14- Failure to implement topic 19
15- Non-implementation of fire regulations
16- Non-implementation of disabled people’s regulations
17- Failure to comply with the height codes of the approved maps
18- Non-observance of the cut seam
19- Failure to report on time
20- Submitting a report contrary to the current situation
21- Non-observance of architecture and urban planning standards
22- Changing chamfer dimensions
23- Eliminating the lobby
24- Failure to implement the guard structure
Cases that mainly lead to sending the case from the Security Council to the Disciplinary Council:
1- Increasing or developing classes
2- Construction of a building in 100% of the property
3- Increasing the height of floors (especially on the ground floor and basement)
4- Additional excavation
5- Commercial construction and development
6- Construction of stairs in the passage
7- Floor shift
8- Moving the staircase
9- Relocating the skylight
10- Removal of parking lot
11- Violation of passage
12- Removal of chamfer (if there is a plaintiff)
13- Change of use
14- Non-observance of the cut seam
The files sent by the security and security department of the General Directorate of Architecture and Building and the sensitive files sent from the municipal areas are discussed in a shorter period of time in the meeting of the Security Council.
It should be mentioned that during the review of the supervising engineer’s case in the Security Council and the Police Council, the supervising engineer was systematically removed from the supervision work referral queue and after going through the above-mentioned steps (which in case of rejection of the complaint, acquittal or acceptance of commitment, usually about 2 4 months and a maximum of 6 months) will be placed in the referral queue again.
