What are the conditions for obtaining the position of mayor in the popularization of governance plan?
In the popularization of governance plan, which was approved in the meeting dated 7/24/1401, after the amendment, the internal affairs commission and the councils of the Islamic Council, the conditions of the people to qualify for the position of mayor are stated as follows: approved by the Islamic Council)
In order to qualify for the position of mayor, the candidates must meet the conditions that each candidate must be approved by the province’s supervisory board contained in the Law on the Organization, Duties and Election of the Islamic Councils of the Country and the Election of Mayors.
1- The only citizenship of the Islamic Republic of Iran
2- Belief in the foundations of the Islamic Republic of Iran and the Constitution
3- Performing public service or having a permanent exemption from service for men
4- Having the physical and mental ability to do the work
5- Having a good reputation and not having a criminal conviction leading to a sentence
6- Living in the city for at least three years
7- No bad moral and security background
8- Lack of simultaneous membership in any of the village and city Islamic councils
9- Not engaging in government work at the same time while holding the position of municipality
10- Educational requirements and executive record will be in accordance with the executive regulations of this article, which will be prepared by the Ministry of Interior in cooperation with the Commission of Internal Affairs and Councils and approved by the Council of Ministers within six months of the approval of this law.
During their tenure, the mayor and city council members cannot be the president or member of the board of directors or the managing director of companies and institutions that provide all or part of the municipality’s affairs. The mayor and the members of the city council and their first-degree relatives do not have the right to be directly or indirectly stakeholders or beneficiaries in transactions and contracts where the municipality or the city council is a party. The supervision of compliance with the provisions of this article is the responsibility of the governor.
The employees of the executive bodies can serve as agents in the position of the mayor, and after the end of the service period, they can return to their primary place of service in compliance with the employment regulations related to the executive body, and the duration of their mission is considered as part of their related service records. In case the mayor is elected from among the employees of the executive bodies by the city council, if the elected person expresses his written consent to assume the position of mayor, the relevant department is obliged to agree to his mission.
