In the public session on the evening of 21 November 1402, the Islamic Council, while examining the details of the 7th Development Plan bill, agreed with paragraph “b” of the amended article 55 of this bill.
According to this paragraph, in order to improve the quality and reduce the costs of housing construction, the following measures are taken:
B- The Ministry of Roads and Urban Development is obliged to revise the technical-property certificate for all newly constructed buildings and also to create and manage its electronic issuance system so that it is possible to grade newly constructed buildings and constructions in the two sections of construction quality and energy efficiency. Four categories should be provided.
Phased completion of technical-property identification certificate is mandatory from the beginning of obtaining the construction permit and during the preparation of phased reports by the supervising engineers until the issuance of the thesis, and the municipalities are obliged to refrain from issuing the thesis for buildings without a technical-property identification certificate approved by the construction engineering system organization and depending on the case. Refer construction violations to the commission of Articles Ninety Nine (99) and One Hundred (100) of the Law of Municipalities, Rural Districts, and Engineering System Inspectors to the Disciplinary Council of the Construction Engineering System Organization for assignment.
From the effective date of this law, the employees of executive bodies are not allowed to act as executors or executors’ representatives in the construction process of buildings.
The executive regulations of this paragraph include the tasks of the devices, technical, executive and building supervision, the processes of preparing and issuing the technical-property certificate of the building, and the industrialization and energy efficiency standards and criteria within six months after the entry into force of this law, with the proposal of the Ministry of Roads. and urban development and is prepared with the cooperation of the ministries of the country, oil and energy, the organization, the engineering system organization and the representative of the Supreme Council of the provinces and it is approved by the cabinet.
