How to calculate hourly contract insurance premium
In the case of hourly and part-time work, should labor and social security regulations be followed or not?
This question and similar questions are frequently asked. Wages are cash or non-cash funds or their sum that is paid to the worker in return for doing work. If the wage is determined and agreed on a daily basis, it is called “daily wage” and if it is related to the hours of work, it is called “hourly wage” and if it is based on the amount of work performed or the product produced, it is called “wage” and If it is based on the product produced or the amount of work done in a certain time, it is called “hourly fee”. Hourly or part-time work is work whose working hours are less than the hours stipulated in the labor law.
According to Atiye Nu, the wages and benefits of workers who work part-time or less than the legally determined hours are calculated and paid in proportion to the hours worked, which will not be less than the minimum hourly salary of the relevant year. In 2015, the minimum salary for one working day is 270,722 Rials and 33,840 Rials per hour.
hourly wage
Hourly wage is the wage that is calculated and paid for the hours that the worker’s time is at the disposal of the employer. In hourly wage contracts, the type of work (regardless of its quantity and amount) as well as the working hours per day, week or month are decisive, which may be less than 44 hours per week or 176 hours per month. In the hourly wage system, in addition to the fixed wage, the employer is obliged to calculate and pay welfare benefits such as the right to housing, the right to groceries, and family allowance to the worker in proportion to the working hours. Establishing an hourly fee system is allowed in the following cases:
A) Cargo and passenger carriers
b) Workers of private doctor’s offices, medical and paramedical clinics, veterinary medicine and the like, if their working hours are less than the maximum legal working hours per day.
c) Non-full-time jobs in the fields of consulting and the like
d) Jobs related to the maintenance and care of property, facilities and buildings and animals, provided that the working hours are less than the maximum legal working hours in a day and night.
e) Educational and research jobs
The wages of workers who are subject to the hourly wage system should not be less than the wages of day-wage workers in the same jobs, in proportion to the normal working hours of the day and night. In workshops whose activities are continuous or seasonal, workers who are paid by the hour have the right to use leave and official holidays with wages.
The basis for calculating wages, salaries, pensions and damages and termination benefits for workers subject to the hourly wage system is the average sum of payments on the last day of their work.
Premiums in hourly and part-time contracts
According to the labor law, all activities and works that are done in return for payment of wages, or employment for another and for the benefit of another, are subject to the labor law, and the manner and extent of cooperation has no effect on this matter. Therefore, hourly and part-time contracts are also subject to the labor law, and accordingly, based on Article 148 of the labor law, they will also be subject to social security regulations. In hourly and part-time jobs, one day’s premium must be paid to the organization’s account for every 8 hours of work. Considering that welfare and incentive benefits are also paid to these workers in proportion to the working hours, the same amount of insurance is also given to the items covered by the insurance such as the ban and the housing fee.
