Regarding supervision of buildings, are only supervising engineers responsible???

The lack of knowledge and nobility of some engineers about the legal laws in the field of urban construction as well as the topics of the national building regulations and the description of the duties of each of the engineering groups in the specialized field and has imposed very heavy costs on the engineering community, unfortunately in this Over the years, with false pretenses and interpretations based on the laws, wrong legal education and lack of solidarity and unity among colleagues, and most importantly, the annoying passivity of many colleagues, especially the engineering system organization, have attacked the engineers and tarnished the image of engineering. Even the supervising engineers themselves have admitted that they are always among the culprits of any accident.

As an example, most of the people involved in the field of construction and engineers, lawyers and official experts. Only one or two paragraphs of Note 7 of Article 100 are out of place, and the rest of the text has not been read, nor does it know that municipal officials are obligated to supervise buildings, just like supervising engineers, and in this regard, they have the same responsibility as supervisors.

The municipal officials are also obliged to have full supervision of the buildings and if they do not prevent violations in the license in time or commit a fault in the issue of the certificate of compliance of the building with the license, their violation will be dealt with according to the regulations and the law. If the actions of supervising engineers and municipal officials have a criminal aspect, they can be prosecuted for this reason as well.

This is a small example of the problems related to the lack of knowledge of the engineers in charge of the rules.

I was studying a case where the municipality blamed the supervisor on the basis of paragraph 2-6-2 of the second topic of the National Building Regulations, and the respected supervisor was convicted in court. I asked the expert of that case why he did not pay attention to Note 7, Article 100 of the Municipal Law, which is preferable to the second topic, because the municipal inspection officer is also obliged to visit the building and in case of violation, to prevent it in time, (the relevant expert answered To my question, he showed the supervisor’s engineer’s defense bill and said that the supervisor did not mention this law and this note in his defense and was found guilty.)

That is, if our dear colleague was aware of the laws, he could have acquitted himself with a proper and legal defense or taken a lesser share of the blame.

Of course, the main problem here is that usually, in such cases, less help is provided to engineers in an organized way from the engineering system organization in terms of legal and intellectual aspects. It is hoped that in the future we will see more activity of the organization in this field.

Hoping for a day when the engineering community, knowing its legal rights, can solve many problems and unjust heresies and restore its lost rights.
