The full text of the bill “Amendment of Article (87) of the Civil Service Management Law – approved 2006-” which was proposed by the Administrative and Employment Organization of the country in the meeting of the Council of Ministers on 8/18/1401 in order to determine the working hours of government offices and the private sector and closing on Thursdays. Explanatory introduction:
In line with the implementation of clauses (1), (9), (12) and (17) of the general policies of the administrative system based on the institutionalization of organizational culture based on Islamic values and human dignity and honoring human and social capital, paying attention to the strength of the family and creating balance between the work and life of people in the administrative system, paying attention to the effectiveness and efficiency in the administrative processes and methods in order to accelerate and facilitate the provision of country services and provide superior, innovative and quality services in order to improve the level of satisfaction and trust of the people, the following bill for formalities Law is submitted:
Bill to amend Article (87) of the Civil Service Management Law
The single article – Article (87) of the Civil Service Management Law – approved 2006 – is amended as follows:
Article 87- The working hours of government employees are 42 hours and 30 minutes per week, and the arrangement and regulation of the working hours of the offices is determined by the proposal of the administrative and employment organization of the country and the approval of the cabinet. It is the responsibility of the relevant body to change the hours of the employees in compliance with the mentioned ceiling and within the framework of the criteria proposed by the Administrative and Employment Organization of the country which is approved by the Board of Ministers. The amount of teaching hours for teachers and faculty members will be determined in the relevant job classification plans.
Note 1- Employees can reduce their working hours up to a quarter of daily working hours (maximum (10) hours) with the approval of the executive body. The amount of salaries and benefits, the way of calculating the service records of such employees will be determined according to their working hours.
Note 2- In special cases, with the approval of the Board of Ministers and compliance with the working hours limit, the executive bodies can adjust their working hours in a different order according to geographical, regional and seasonal conditions.
Note 3- In accordance with technological changes and in emergencies and crisis situations such as air pollution, energy shortages, unexpected incidents, outbreaks of widespread diseases, or during special days such as the holy month of Ramadan, at the suggestion of the administrative and employment organization of the country and the approval of the Cabinet of Ministers, the hours The work and the way of providing the service of the employees are determined regardless of the ceiling mentioned in this article.
Note 4- All executive bodies, including headquarters and provinces, with the exception of the operational department of service centers and units, such as welfare-related units, banks, hospitals, health-treatment centers, sports facilities, and military, law enforcement, and security units, are required to limit their working hours to five Set the day of the week.
Note 5- In all the laws and regulations that used the basis of forty-four hours of work per week and one hundred and seventy-six hours of work per month, from the date of promulgation of this law, respectively, it will be forty-two hours and thirty minutes of work per week. And one hundred and seventy working hours per month are fixed.
