Three Laws of Advocacy
1- Contractual representation is permissible, it means a contract that ends with the death of one of the parties, or the resignation of the lawyer, or the dismissal of the lawyer by the client, or the insanity of the lawyer or the client. For example, if someone gives a power of attorney to someone else to buy a car for him, the person who gives the power of attorney is called a client, and the person who has to buy a car is called a lawyer. Now, if the lawyer becomes insane or dies before buying a car, or resigns from doing that act, or the client dismisses him, he will no longer be allowed to do the car transaction.
2- According to the law, a power of attorney contract is terminated by the death or insanity of the lawyer or the client, and in this respect, there is no difference between a power of attorney contract or a simple power of attorney contract. So, if a person contracts an apartment with Mr. (B) with a normal document and it is stated in the contract that the buyer is a lawyer on behalf of Mr. Seller, after completing the notarial and administrative formalities, he goes to the office and officially transfers the apartment to his name and to The term buyer has power of attorney from the seller, but if the seller dies in order to officially transfer the apartment, then the power of attorney is no longer effective and it is the seller’s heirs who must transfer the apartment, and if they refuse to do this, then the buyer will have to File a lawsuit against them and go to court. Therefore, if the power of attorney contract is included in the contract of sale or any other necessary contract such as the marriage contract, etc., this power of attorney will remain in effect until the parties are not infected with insanity or have died.
3-According to the law, the client can dismiss his lawyer whenever he wants, but the parties can condition the lawyer’s non-dismissal in the contract. Now this question arises: can the client act as a lawyer himself or is this right only limited to the lawyer?
