Until March 2017, refugees who had a 5-year refugee stay applied for permanent residence by filling in the SET (P) form 28 days before the end of their refugee stay and received permanent residence automatically. Of course, if they had not done anything wrong during their stay in this country. Sometimes committing a crime or a mistake caused their visa to be extended for 3 years instead of permanent residence.
Last March 2017, the news of the following new law was published in all news:
Home Office ends policy of automatic settlement for refugees after five
The Safe Return Policy law became effective on the same date, but we did not hear much about it until almost 2 weeks ago.
Those whose permanent residence requests are rejected after the approval of this law can face the risk of detention or removal. Usually, these people have the right to appeal and have to go to court again to prove their right.
During the last 2 weeks, we saw that the compatriots were invited for interviews again. The Home Office has also requested additional documents related to the original asylum application.
For example, church letters were requested from several applicants whose cases were based on conversion to Christianity.
Of course, don’t forget that according to the law, the Home Office always has the right to review the requests at any time during the applicant’s stay.
Please note that SET (P) form from November 2018 must be done online only.
