Therefore, in the agenda of last week’s public session of the Parliament, it was found that some representatives demanded the implementation of Article 85 of the Constitution regarding the consideration of this plan.
Finally, the members of the Islamic Council approved the review of the cyberspace organization plan according to Article 85 of the Constitution.
According to Article 85 of the Constitution, “the position of representation is vested in a person and cannot be transferred to another person. The parliament cannot delegate the power of legislation to a person or a board, but in necessary cases, it can delegate the authority to enact some laws to its internal commissions in compliance with the seventy-second principle, in this case, these laws will be implemented on a trial basis during the period determined by the parliament. and their final approval will be with the parliament.”
Therefore, with the consent of the representatives to this request, the plan to protect the rights of users in the virtual space will be reviewed in the joint and special commission instead of in the open floor of the parliament.
